The judge who awarded Kelly Rutherford’s ex-husband, Daniel Giersch, full custody of their children in Monaco has written one of the major reasons for it in court documents.
As we previously reported, Rutherford filed an appeal to the ruling over the weekend.
In documents obtained by TMZ, the judge said Gierch was awarded full custody because there’s "a strong risk of the children's abduction and retention in the United States” on the former Gossip Girl star’s behalf.
The basis for this argument stems back to August, when Rutherford refused to send Hermes, 8, and Helena, 6, back to Monaco after a summer visit with her in New York. A judge then ordered her to hand over the kids to their paternal grandmother to be returned to their father.
She has since flown to Monaco to fight for custody there, which didn’t work out in her favor.
Rutherford has been fighting for custody of her kids for the past six years, exhausting all of her financial resources.
