Kelly Rutherford has reportedly lost the custody battle of her two young children after a judge in Monaco awarded full custody to her ex-husband, Daniel Giersch.
According to the Daily Mail, after a battle which lasted six years, the judge decided to grant full parental custody of Hermes and Helena to Giersch, a German business man.
Under the ruling, Rutherford and Giersch will make decisions together on the children’s "health, schooling, religious education and any change of residence."
The order obtained by the Daily Mail Online goes on to state that Rutherford is "permitted to exercise her visiting and accommodation rights exclusively in France and Monaco," but the children will continue to live with their father. Rutherford and Giersch will split holidays as well as spring and summer vacations. The 47-year-old actress will also receive $3,281 a month for her travels.
As we previously reported, Rutherford was reunited with her children last summer, but refused to give them back on Aug. 7. At that time, a New York judge ordered that the kids be given to their paternal grandmother and then flown back to their father in Monaco.
The former Gossip Girl and Melrose Place star plans to appeal the latest ruling.
