Up until a court hearing on Tuesday, March 21, Bethenny Frankel was paying her ex Jason Hoppy nearly $12,000 in spousal support a month. She’s now satisfied with a New York judge’s decision to waive his right to temporary maintenance as they try to come to a divorce agreement.
The judge upheld the prenuptial agreement clause that Hoppy signed to waive his rights to spousal support or maintenance, though his attorney Bernard Clair told People the “words to extinguish the right did not appear in the prenup."
According to E! News, Frankel will still have to pay him $10,000 a month in child support for their daughter, Bryn. She’s been paying him a total of nearly $26,000 a month since their 2012 split between the child support and temporary alimony.
The issue of their marital home, the $5 million Tribeca condo Frankel paid for during their marriage that Hoppy has been living in since their split, is still up in the air.
Court documents read, “The husband avers that the parties had agreed that the apartment would be joint property, and that consistent with the intention, he made certain payments towards maintenance and renovations."
Frankel has accused him of “fraudulent behavior and unclean hands” when it comes to a trust they purchased the home with, which states them both as beneficiaries.
“Issues of fact exist whether the parties intended to jointly own the apartment, and whether the husband was involved in any fraud in the preparation and execution of the trust agreement," said the court.
