Eminem’s music publisher filed a lawsuit against Facebook and its ad agency. Eight Mile Style claimed Facebook used the rapper’s music for an online ad.

According to Rolling Stone Eight Mile Style filed a complaint in Detroit federal court alleging Facebook copied music from the Detroit rapper’s “Under the Influence.”

Eight Mile Style also went after the ad agency Wieden + Kennedy claiming the company used Eminem’s music “in an effort to curry favor with Facebook by catering to [Facebook founder Mark] Zuckerberg’s personal likes and interests, and/or invoke the same irreverent theme,” according to the Detroit Free Press.

Wieden + Kennedy has worked with Eight Mile Style before on the 2011 Super Bowl ad with Chrysler that featured an authorized version of Eminem’s track “Lose Yourself.” Eight Mile Style has been in this position before. They settled out of court with Apple in 2005 after they used “Lose Yourself” in and iPod commercial without permission, and settled with Audi in 2011 over a song that sounded like “Lose Yourself” in Audi’s ad.

Eminem is working on a follow up to 2010’s Recovery.
