Prosecutors have filed an appeal over the controversial 31-day jail sentence Stacey Dean Rambold served after being convicted of raping a 14-year-old girl.
As previously reported Rambold was convicted of raping Cherice Morales in 2008 - three years later she would kill herself.
Prosecutors in the case had hoped to get a 20-year sentence, but instead Judge G. Todd Baugh gave Rambold 31-days, with one day served. The judge then sent the story national by publicly commenting his thoughts on the case. He placed some of the blame on Morales saying she was "as much in control of the situation" as Rambold.
Another mistake that Baugh made was in giving out a sentence that was immensely lighter than the mandatory minimum of two years that is required for Rambold's crime.
Prosecutors on the case promised to continue the fight and on Friday filed an appeal, CNN reports.
The filing statement noted that "The circumstances of a 47-year-old teacher having sexual intercourse with his 14-year-old student is precisely such a circumstance warranting a mandatory minimum sentence." Prosecutors are pushing for at least 10 years.
Baugh apologized after making the controversial comments saying, "I made some references to the victim's age and control. I'm not sure just what I was attempting to say at that point, but it didn't come out correct. What I said was demeaning to all women, not what I believe in and irrelevant to the sentencing."
