Investigator says 'Midnight Rider' crew weren't to be on train tracks

An investigator has said that the crew working on the Gregg Allman biopic Midnight Rider weren't supposed to be filming on the tracks.

According to Variety, the crew did not have permission from CSX Railroad to be filming on the train tracks. They did have permission from the company Rayonier, who owned the land, to be filming on the property, though.

Lead detective Joe Gardner said, "CSX has told me they were aware they were out there, but they did not have permission to be on the train tracks."

As previously reported, the crew was supposedly aware of two trains that were to cross the tracks during their shoot, but the third came as a surprise.

The accident resulted in the death of a 27-year-old and seven others were injured.

Variety notes they were filming a dream sequence and director Randall Miller claimed they were told they would have a minute to clear the tracks if a whistle sounded, signifying the approach of a train.
