Drake has been targeted in a lawsuit involving his song “Pound Cake” feat. Jay Z, which is featured on his album Nothing Was the Same. The late jazz musician Jimmy Smith’s estate is suing Drake for using a sampling of his song “Jimmy Smith Rap" from 1982 without permission.

In the lawsuit, obtained by TMZ, Smith’s estate claims not only did Drake use lyrics without getting them cleared first, but he also lied in the liner notes that he got them properly licensed.

The estate is suing Drake, his label YMCMB, and others for $300,000 in damages.

MTV News reports the line in question comes from "Pound Cake/Paris Morton Music 2" when a voice is heard in the beginning saying in part "Only real music is gonna last. All the other bulls--- is here today and gone tomorrow." The sampling lasts 35 seconds.

Drake’s team couldn’t be reached for comment regarding the lawsuit.
