A California woman who ran over and killed a teenage boy and injured two others on bikes is reportedly suing the family of the dead boy for $1.35 million.

The New York Post reports that Sharlene Simon, 42, is suing the family of the 17-year-old boy for $1.35 million due to psychological suffering from the accident, including depression, anxiety, irritability, and post-traumatic stress.

On October 28, 2012, Simon struck and killed Brandon Majewski with her SUV from behind, while he and two of his friends were riding bikes along the road at approximately 1:30 a.m.

Sixteen year old Richard McLean broke multiple bones, including his pelvis and 16-year-old Jake Roberts suffered from only minor scratches.

“In all of my years as a lawyer, I have never seen anyone sue a child that they killed. It's beyond the pale. I just couldn't bring myself to tell them on the phone,” the family’s lawyer, Brian Cameron said, according to The NY Daily News.

Simon’s claim states that the boys were “incompetent motorists” who didn't use their brakes properly. She told police that she didn't see the boys or any reflectors on the bikes and ultimately was not charged.

The Majewski family is also suing Simon, claiming that she was speeding and may have been intoxicated or talking on the phone.

“She killed my child and now she wants to profit from it? She says she is in pain?” Brandon’s mother, Venetta said. “Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares.”
