After spending 24 years in prison, Brooklyn prosecutors say Jonathan Fleming will be released after being wrongly convicted.
The 51-year-old was convicted in the 1989 fatal shooting of Darryl Rush in Williamsburg, Brooklyn, though Fleming claimed he wasn't even in the state at the time, reports New York Daily News, who was the first to report his impending release.
Fleming claimed that he was actually in Florida and it appears that new evidence was revealed that backs up his side of the story. So his murder conviction is set to be thrown out. Anthony Mayol, Fleming's attorney, said, "He's elated, after all these years." He added Fleming is "in an amazing place right now."
According to The Associated Press, despite having plane tickets and other physical proof he was in Florida, prosecutors claimed he could still have been in New York at the time. Plus they claimed to have a witness to the shooting, which authorities believed was over money.
The witness was a drug addict who later recanted, claiming she was pressured into making false testimony so she wouldn't be charged for an unrelated crime. Daily News notes the judge let her testimony stand anyway.
Defense investigators have also said they have found other witnesses that prove Fleming wasn't the shooter, but that it was someone else.
