Glenn Danzig, the former frontman for Misfits, is suing the group’s bassist, Jerry Only, for cutting him out of a merchandising deal with the Hot Topic retail chain. Danzig claims that he is losing out on millions by not getting any revenue from the wide variety of products the store sells with the group’s name.
Danzig’s suit says that Only registered trademarks for Misfits-related logos in 2000 without letting him know, reports Re-Tox. Therefore, Only made it so that he had exclusive ownership of the ‘Fiend Skull’ logo and the Misfits’ other related logos.
That move violated a 1994 deal that said Danzig, Only and other members of the group shared equal ownership of the Misfits’ logos for merchandise.
Next, Only made secret agreements with Hot Topic and other stores, Danzig claims and specifically shut him out from making any money. He even threatened to cut stores off from licensing deals if they ever worked with Danzig, according to Danzig.
Danzig left the band in 1983. According to Noisy, the lawsuit does include a dig and Only, whose real last name is Caiafa. “After forming the band, Danzig replaced the original bass player with Caiafa, whose primary qualification was that he had recently received a bass guitar for Christmas,” the lawsuit states.
