A Texas man has filed a lawsuit against the doctors he says mistakenly removed his healthy kidney instead of his cancerous one.

According to CBSDFW, Glenn Hermes of Arlington is seeking more than $1 million in damages from his urologist and a radiologist for malpractice and gross negligence.

The Fort Worth Star-Telegram reported that Hermes claimed that the error happened after the doctors misread his pathology report.

He alleges that he was told he had a mass growing on his left kidney, but after the procedure doctors found that the mass was actually on his right kidney. He then had to have part of the remaining kidney taken out, which has complicated his kidney function even more.

The 55-year-old said that he is now cancer-free, but because of the major mistake is awaiting word if he will need dialysis or even a transplant in the future.

The lawsuit was filed by Hermes and his wife, Bernadette, on Tuesday.

An agent for the Radiology Associates has not yet commented on the issue.
