Chris Brown and his prosecutors were unable to make a plea agreement in his assault case.

New developments in the case happened on Wednesday. Prosecutor Kevin Chambers said that they offered a deal for Brown to plead guilty to simple assault, according to the Associated Press.

Brown’s attorney, Mark Geragos, has been fighting for his client, and said that there is no conclusive statement of facts in term of what happened that October outside of W hotel.

It is a complicated case that involves the volatile recording artist and his former girlfriend Rihanna. Brown was on probation for attacking Rihanna in 2009. While still on probation, Brown got in an altercation with a fan who hit him.

Brown has done hours in a rehabilitation facility for anger management since then. In the past, he had blamed his friends for his behavior, saying that they got him into drugs.

Brown has been released from jail. He appeared in court on Wednesday in simple clothes including jeans, a leather jacket, and a tie.

A trial for Brown was scheduled for September 8.
