Katherine Heigl has withdrawn her $6 million lawsuit targeting chain store Duane Reade for tweeting a picture of the actress.
As previously reported, the drugstore chain took to Twitter and Facebook to post a paparazzi photograph of the actress carrying a Duane Reade bag.
In a now-deleted tweet, the New York-based company said, "Love a quick #DuaneReade run? Even @KatieHeigl can't resist shopping #NYC's favorite drugstore."
The Knocked Up actress was not amused and filed a lawsuit against Duane Reade for using both her name and image and that the company violated the false advertising provision of the Lanham Act. The complaint said Heigl "is highly selective and well compensated" for any endorsements she makes.
Now, more than four months later, Heigl has decided to dismiss with prejudice, meaning she can't change her mind later and try and sue again over the social media move, according to The Hollywood Reporter, who first learned of the news.
"Katherine Heigl and Duane Reade have worked out a mutually beneficial agreement," Peter Haviland, Hiegl's attorney, said. "Ms. Heigl has voluntarily dismissed her lawsuit, and Duane Read has made a contribution to benefit the Jason Debus Hiegl Foundation."
Exactly how much the drugstore chain had to shell out to shut down the lawsuit has not been revealed.
