Things aren't going well for actor Emile Hirsch, who was charged Thursday, Feb. 12 with assault for putting a female in a choke hold.

Hirsch, who is known for his work in Bonnie & Clyde back in 2013 and other films such as Into the Wild and Lone Survivor , has been charged with assault after it was alleged that during an argument he put a female in a choke hold while he was in Utah for the Sundance Film Festival, AP reports.

Hirsch was charged with assault, for which he can be sentenced to jail for up to five years and pay a hefty fine. Hirsch was in fact intoxicated and faces another charge for that.

Danielle Bernfeld, an executive for Insurge Pictures, is the female who was involved. They had an argument that resulted in Bernfeld being put in a choke hold and pulled across the table before they hit the floor. Hirsch landed on top of her.

Court documents say the altercation occurred on Jan. 25 at Tao Nightclub in Park City, Utah.

Hirsch, 29, was not arrested and was scheduled to make his first court appearance March 16 at a court in Park City. Nobody knows why charges were filed weeks later.

Unsuccessful attempts to reach Bernfeld and Insurge Pictures were made.

Hirsch was at Sundance to promote his film Ten Thousand Saints .
