Nick Loeb, who split from Sofia Vergara nearly a year ago, is suing the Modern Family star in an effort to save two female embryos created through in vitro fertilization.
Court documents were first obtained by In Touch, showing that Loeb claims that in November 2013, the couple created embryos with his sperm and her eggs. That was just six months before they called it quits for good.
Loeb first filed the lawsuit in August 2014, but refiled again on April 1 after he got new attorneys. It was filed under the name John Doe, who “seeks to ensure that the Female Embryos are not destroyed, but Jane Doe [Sofía] refuses to agree to their preservation under all circumstances.”
TMZ reports that Loeb says Vergara now wants to destroy the embryos, since they are no longer together.
But that’s not all that’s in the suit. Loeb also brings up allegations of physical abuse against Vergara. He claims she abused him four different times and often called him a “loser” and other insults.
Despite that, he still wants a baby with her.
“Nick has always wanted to be a father and will do whatever it takes to save these two remaining female embryos,” an insider told InTouch. “Nick is very emotionally invested in these female embryos because he’s pro-life and believes life begins at conception.”
Vergara moved on from her relationship with Loeb quickly. In December 2014, she got engaged to Magic Mike XXL star Joe Manganiello.
