Tori Spelling has filed a lawsuit against Benihana due to suffering third degree burns on her right arm after tripping and falling on a hibachi grill at the company’s Encino Calif. location back in April.

She was hospitalized for the severe burns after tripping when her heel got stuck. She was there for Easter brunch with her husband, Dean McDermott, and their four kids; Liam, Stella, Hattie and Finn.

In the lawsuit, which is against the entire Benihana corporation not just the location she fell at, Spelling declared she’s suing for medical expenses, lost wages, and other damages, TMZ reports.

She also stated she has "deep second and third degree burn injuries” from the incident.

McDermott has previously said they weren’t sure if they were going to pursue legal action, but did call it an “unfortunate accident."

"She had a little burn,” he said. “She had to get skin grafts.”
