Attorneys for convicted Boston Marathon bomber Dzhokhar Tsarnaev were in court today to argued that their client should be granted a new trial.
In April, Tsarnaev was found guilty of the bombing and later given the death penalty. During the trial his lawyers did not deny that he was involved, but said that he was under the control of his now-deceased brother Tamarlan, whom they claimed was the mastermind.
The Associated Press noted that on Tuesday, Tsarnaev’s attorneys said that due to a June Supreme Court ruling, a jury may have not charged their client with 15 of the 30 counts. The lawyers also went back to asking that a new trial be held outside of Boston, something that they repeatedly asked for throughout the initial trial.
Judge George O'Toole Jr. has not yet ruled on whether a motion for another trial will be granted.
Tsarnaev was convicted on every charge for the 2013 bombing that killed Krystle Campbell, 29; Martin Richard, 8; Lingzi Lu, 23 and injured an additional 260 people.
