Camille Cosby, Bill Cosby’s wife, is hoping to delay her deposition on Wednesday in a defamation lawsuit her husband is facing.

On Friday, a Massachusetts judge denied a request from Camille Cosby’s attorneys to not have her forced to testify in the case. CNN reports that her attorneys filed an emergency motion in federal court, asking for a stay or delay her deposition. She hopes that the court will consider an appeal of the Friday decision.

In December 2014, seven of the women who have accused Bill Cosby of sexual assault and/or drugging them filed the defamation lawsuit after he denied their claims. Cosby then countersued them for defamation.

According to the New York Daily News, Camille Cosby claims in her motion that, if she does testify in the case under oath, she would then lose her marital privilege if the case gets to a trial.

“Under Massachusetts law, a spouse who provides an answer about such communications is considered to have waived the privilege,” the filing reads. “As such, the magistrate's order creating an exception for deposition testimony would potentially swallow up the entire disqualification rule.”

On Dec. 30, Cosby was charged with aggravated indecent assault against Andrea Constand, who claims that she was assaulted and drugged by the comedian in 2004. It is the first time he has faced charges after over 40 women have claimed that Cosby sexually assaulted and drugged them.
