Bill Cosby has filed a lawsuit against Andrea Constand, the only woman whose accusations against the comedian have lead to criminal charges against him.
In Dec. 2015, Cosby was charged with aggravated indecent assault against Constand in a 2004 incident, even though the Montgomery County, Pennsylvania district attorney at that time did not charge Cosby. The current D.A., Kevin R. Steele, said that there was enough evidence now to charge the former Cosby Show star.
According to The Associated Press, Cosby is now suing Constand for breach of contract. The other defendants are Constand’s mother and lawyer, as well as the National Enquirer’s publisher. The lawsuit is under seal and Cosby’s lawyers would not comment.
It’s likely that Cosby’s attorneys are suing Constand for breaching a confidentiality agreement signed in 2005 after Constand and Cosby reached a settlement before her civil lawsuit would have gone to trial. Constand’s mother, Gianna Constand, could be included because, as the criminal complaint against Cosby shows, Cosby called Gianna after the alleged incident in 2005. In that call, which might have been recorded, Cosby allegedly detailed what he did to Constand.
The lawsuit was actually filed back on Feb. 1, the day before Constand’s lawyer, Dolores Troiani, testified that Cosby had sued her. The testimony occurred during a hearing after Cosby’s attorneys filed a motion to have his criminal charges dismissed, notes USA Today. They failed and the charges will not be dismissed.
