John Creech, a convicted drug dealer, has been indicted for the alleged murder of 20th Century Fox executive Gavin Smith.
Smith was last seen by his family in May 2012 and declared deceased by the Los Angeles Sheriff’s Department in May 2014. His remains were found in November 2014.
His Mercedes-Benz 420E was found in March 2013 at a storage facility that was linked to Creech.
On Wednesday, a grand jury indicted Creech, charging him with a count of capital murder, reports KTLA, which makes him eligible for the death penalty. He is currently serving an eight-year sentence for sale or transportation of drugs.
According to the Los Angeles Times, detectives believe they are linked through Creech’s wife. Smith and his wife met in a rehabilitation program.
CBS LA reports that Creech’s attorney did admit that his client got into a fight with Smith, but said Smith died after a “tragic accident.”
Smith’s death is still under investigation.
