Lindsay Lohan’s lawsuit against Take-Two and Rockstar Games, the creators of Grand Theft Auto V, will move forward in a New York court.
Lohan first sued the makers of the game back in July 2014, claiming the game’s character Lacey Jonas is based off of her likeness without her consent. The following month, the two companies asked the judge to drop the lawsuit, claiming she was doing it for publicity.
According to Polygon, New York State Supreme Court judge Joan Kennedy ruled on March 11 that the lawsuit can progress. Take-Two also tried to argue that the lawsuit should be dropped based on the one-year statute of limitations running out, but Judge Kennedy denied the motion.
Grand Theft Auto V was released on Sept. 2013 and it surpassed $1 billion in sales just three days after hitting store shelves.
